James Herman Daugherty, 75, of 414 Jeffries Lane, Hustonville, died Thursday, Aug. 16, 2007 from injuries sustained in an accident on the U.S. 127 Bypass in Mercer County at 11:49 p.m. Tuesday, Aug. 14.

Daugherty was traveling south on the bypass in a van and was approaching the intersection of the bypass and South College Street when his dog distracted him.

Daugherty told Ptl. Scott Elder that the dog jumped from the passenger seat into the back of the van and he was attempting to restrain it when his van collided with a guard rail.

A witness told police that Daugherty did not slow down or attempt to make a turn at the intersection, but ran straight into the guard rail and that he was traveling between 50 and 60 MPH.

After the van hit the guard rail, it made a complete 360 degree spin and landed in a ditch. The vehicle was severely damaged.

Elder found Daugherty lying on his right side partially on a piece of guard rail and partially on the ground. The van was sitting on a large piece of guard rail.

Daugherty had multiple cuts and scrapes on his face and arms, but was coherent at the time and able to answer questions. He complained of back pain.

Mercer County EMS paramedics transported him to the Ephraim McDowell Regional Medical Center in Danville and he was later transported to the University of Kentucky Medical Center in Lexington.

Elder stated ti appeared Daugherty, who was not wearing a seat belt, was ejected out the driver’s side window of he van. The window was down.

Daugherty suffered multiple injuries and died at 10:12 p.m. Aug. 16 at the UK Medical Center. Officials said the cause of death was from head injuries.
