Dr. Bertold Pembauer of Avondale dies

Dr. Bertold Pembaur will be remembered by his many patients as a caring doctor and by the general public as someone who stood up for his constitutional rights, his son said.

Dr. Pembaur, a longtime family physician with offices in Avondale, died Monday at Terrace View Nursing Home of complications of heart disease and stroke. He was 80.

''He really showed an interest in his patients,'' said his son, Dr. Berthold Pembaur, an internist with Group Health Associates in Kenwood. ''He always took time to get down to the bott om of the case to help them.''

The younger Pembaur said he was inspired to enter the medical profession by his father, a native of Salzburg, Austria, who immigrated to the United States in 1951. After finishing his medical studies at the University of Innsbruck, Dr. Pembaur did a residency at Deaconess Hospita l. He moved his practice from the West End to Avondale in 1959. His Rockdale Medical Center in Avondale grew to one of the largest single-physician practices in Ohio in the early 1970s.

''I still see patients of his that say, 'I went to your dad.' I always hear he was a great doctor,'' Pembaur said.

Dr. Pembaur became involved in one of the longest trials in Hamilton County history after bei ng indicted in 1977 on charges of felony Medicaid fraud. He was acquitted by a jury in 1981.

After his acquittal, Dr. Pembaur sued Hamilton County and the city of Cincinnati over an incident on May 19, 1977, in which police officers broke down his office door with an axe. Dr. Pembaur appealed all the way to the U.S. Supreme Court, which ruled in his favor in 1986.

Dr. Pembaur's son said the Supreme Court case is still cited in privacy cases involving med ical records and doctor-patient privilege.

''He was a proud man. He had his beliefs and he stood up for his beliefs,'' he said.

Other survivors include his wife, Joan Elizabeth Pembaur; sons, Robert and Derrick Pembaur, both of Cincinnati; two daughters, Elizabeth Harpenau of Cincinnati, and Odilie Pembaur of Bonn, Germany; a sister, Waltraud Pembaur Cate of Portola Valley, Calif.; and nine grandchildren.

A memorial Mass will begin at 10 a.m. Tuesday at Our Lady of Lourdes Church in Westwood. Dr. Pembaur's body has been cremated, and burial will take place in Germany.

Memorial contributions may be made to the American Cancer Society, Hamilton County Unit, 1111 7 Kenwood Road, Cincinnati.
