Mrs. Daniel was a member of True Light Missionary Baptist Church in Solway and had served the church as president of the choir, ass a teacher in the church school and as a kitchen worker.

She was born in Lee County, Ala., on July 2, 1925, the daughter of Joseph and Elvester Cooper Upshaw.

Mrs. Daniel had lived in Oak Ridge since 1958. She enjoyed cooking, singing and helping others, her family said.

She had last worked as a cook for Knoxville College.

According to Neil McBride, director of Rural Legal Services of Tennessee, Mrs. Daniel was the lead plaintiff in a lawsuit that has shaped the way hundreds of thousands of people receive health care in Tennessee. In 1979, Rural Legal Services filed the suit as a class action on behalf of Mrs. Daniel and others. The suit, now called Daniel et al. v. Menke, was filed in 1979 in U.S. District Court in Nashville.

Mrs. Daniel and others sued to stop several violations of federal law in the management of the Medicaid health care program for low-income people.

Oak Ridge attorney Lenny Croce, who represented Mrs. Daniel, explained that all professional health care managers in Tennessee, and many throughout the country, know about the Daniel case. As a result of Mrs. Daniel's leadership, thousands of families have stronger due-process rights, better access to transportation in rural areas and clearer standards for eligibility for health insurance. Croce said Mrs. Daniel left a tremendous legacy to thousands of the most vulnerable families in Tennessee.
