Cluster Upshaw Daniel
Legislative trailblazer

Cluster Olivia Upshaw Daniel, 72, of Oak Ridge, died Sunday, Nov. 9, 1997, at Fort Sanders Regional Medical Center in Knoxville.

Mrs. Daniel was a member of True Light Missionary Baptist Church in Solway and had served the church as president of the choir, as a teacher in the church school and as a kitchen worker.

She was born in Lee County, Ala., on July 2, 1925, the daughter of Joseph and Elvester Cooper Upshaw.

Mrs. Daniel had lived in Oak Ridge since 1958. She enjoyed cooking, singing and helping others, her family said.

She had last worked as a cook for Knoxville College.

According to Neil McBride, director of Rural Legal Services of Tennessee, Mrs. Daniel was the lead plaintiff in a lawsuit that has shaped the way hundreds of thousands of people receive health care in Tennessee. In 1979, Rural Legal Services filed the suit as a class action on behalf of Mrs. Daniel and others. The suit, now called Daniel et al. v. Menke, was filed in 1979 in U.S. District Court in Nashville.

Mrs. Daniel and others sued to stop several violations of federal law in the management of the Medicaid health care program for low-income people.

Oak Ridge attorney Lenny Croce, who represented Mrs. Daniel, explained that all professional health care managers in Tennessee, and many throughout the country, know about the Daniel case. As a result of Mrs. Daniel's leadership, thousands of families have stronger due-process rights, better access to transportation in rural areas and clearer standards for eligibility for health insurance. Croce said Mrs. Daniel left a tremendous legacy to thousands of the most vulnerable families in Tennessee.

She is survived by her husband, David Daniel; three daughters, Ira Daniel of Los Angeles, Calif., Almarie Revels and her husband, Ronnie, of Knoxville, and Pinkie Daniel of Oak Ridge; three brothers, Elmore Upshaw of New York, N.Y., Willie Lee Upshaw of Bronx, N.Y., and Willie Joseph Upshaw of Salem, Ala.; and four sisters-in-law, Mattie Giles and her husband, Roy, of Mobile, Ala., Edith Upshaw of New York City, Willie Upshaw of Montgomery, Ala., and Katie Bandy of Opelika, Ala.

Mrs. Daniel is also survived by an aunt, Mary Cooper of Apopka, Fla.; three grandchildren, Michelle Hashaway and LaShawn C. Valley, both of Los Angeles, and Shervena Revels of Knoxville; one grandson, Ronnie Revels of Knoxville; and four great-grandchildren, Alfonzo Clark, Antwane Sims Jr., Markese Enge and Daffney Hashaway, all of Los Angeles.

Also surviving are two nieces and two nephews, Marsha Simmons of Newark, N.J., Patricia Giles of Atlanta, Ga., Phillip Upshaw of New York City and Bernard Upshaw of Landover, Md.; and several cousins and other relatives, including Bertha Morgan, Mavis Ware and Lola Edward, all of Camp Hill, Ala., and Janie Shakespeare of Los Angeles.

Oak Ridge residents Mary Lou and Woody Chilcoat, Emma Sutton, Hattie and Jackson Friendly, Fannie Henderson and Fannie Ball were considered special friends, as well as the Rev. Dozier and Ora McKinnon. Mr. McKinnon was Mrs. Daniel's longtime pastor and friend.

The funeral will be held at 2 p.m. Saturday, Nov. 15, at True Light Missionary Baptist Church in the Solway community with the Rev. Dozier McKinnon officiating.

Burial will be at Oak Ridge Memorial Park.

The family will receive friends from noon to 2 p.m. Saturday at the church.

The family requests any memorials be in the form of donations to True Light Missionary Baptist Church, 3229 George Light Road, Knoxville, TN 37931.
